Senior Elderly Testators: For seniors, we may have to speak to the testator (via phone or video call) before we can accept instructions. To make a Will, you must have testamentary capacity and make the Will out of own free will and without any undue influence or pressure from others.

WORLDWIDE OR SINGAPORE ASSETS ONLY

Commonly, your Will will cover Worldwide assets unless you wish to cover your assets outside Singapore by way of separate Will(s) executed in those countries, or you have already done Will(s) covering those overseas assets.

For example, if you have properties in India and have already done a Will in India to cover those Indian assets, you may wish to exclude your assets in India in your Singapore Will. 

CHILDREN

This section relates to gifts concerning your children.

Excluding Any Child

If you are excluding any child or children from your Will, please specify brief reasons. For example, you have already provided adequately for your adult child John, and therefore wish to provide for your other children.

If Child Dies before You

In the unlikely event that your child dies before you, how do you wish to deal with his share. 

For example, you give to your 3 adult children in equal shares (1/3 each), and if one of them dies before you, how do you wish to deal with his share? If that child dies before you, his lawful childen (if any) will share your a 1/3 share under the Wills Act. If you wish to specify how to deal with his share, you may specify that his share is distributed as follows (examples only, not exhaustive):

- to your surviving children equally

- to his child (your grandchildren) equally

- to his descendants (your grandchidren, great-grandchildren, etc) (called "issues")

MEDICAL CERTIFICATE

For senior applicant, we may require doctor's certificate on your mental capacity, ie. your testamentary capacity. For those 81 and above, our lawyer may need to do a phone call or video call before we can accept engagement.
This is encouraged for elderly testator.

EXECUTORS AND TRUSTEESYou need at least one executor

This section is mandatory

What does "Executor and Trustee" mean? An Executor is a person you appoint to carry out the instructions and distribute the assets in your Will after your death. You may choose someone you trust, such as a spouse, parent, sibling, cousin, or close friend. You must appoint at least one Executor. The person you leave your assets to can also act as your Executor. For instance, if you plan to give everything to your wife, you may appoint her as your Sole Executor unless you have a reason not to. The term "Executor" in this form refers to the capacity of both "Executor and Trustee."

Executor Section Explanation: You must nominate at least one Original Executor. If you appoint more than one, they will act together, unless one of them declines, is unable to act, or has passed away. The appointed Executor must be 21 years old at the time of Probate application. If they are under 21 at the time of your death, you may still appoint them as your Executor, as long as they are of age at the time of Probate application. They cannot be an undischarged bankrupt at the time of Probate. This section allows you to appoint up to three Original Executors. Please complete the details of Executor 1 first, and if you wish to appoint more, select the appropriate answer in the "Role" field.

SUBSTITUTE EXECUTOR(S) (IF ANY)

Kindly indicate if you want to appoint a substitute executor who will take the place of the original executor in the event they are unable to fulfill their duties for any reason. The substitute executor is also referred to as a "replacement executor." As an example, if you appoint your wife, Mary, as the original executor, you may choose to appoint your adult son, Albert (who is also a beneficiary), as the substitute executor. This is in the event that your wife passes away before you. GUARDIANSHIP (IF REQUIRED)

This section is optional. If you have minor children under the age of 21, it is recommended that you appoint a guardian in the event of your spouse's death or to act jointly with him/her. The guardian should be someone you trust and can rely on to take care of your child's welfare and interests. This person can be a relative, such as a brother or sister. You may also choose the same executor to be the guardian of your child. Do not appoint your spouse or ex-spouse as the guardian, as they are the legal parent. Wills Registry is a voluntary confidential registry maintained by Singapore Academy of Law (SAL) where a Testator (person making a Will) or his lawyer can deposit information on his Will. A Mirror Will is specially created for couples who are married or in a close relationship with identical or similar wishes. It is a distinct and separate document from a Mutual Will and comes with its own cost. For instance, if the husband completes the form, the wife can opt to have a similar Will by selecting "Yes" and avoid filling out the form herself. We will then prepare separate Wills for both the husband and wife, using the information already provided by the husband. It's important to note that we do not offer services for creating Mutual Wills.

Disability includes stroke, visual and hearing impairment, cognitive impairment (eg. dementia, paralysis)

Please let us know if you have any medical report on your disability, particularly, if it covers your mental capacity to make a Will.

LASTING POWER OF ATTORNEY (LPA)

A Will takes effect upon death, and not upon losing mental capacity. If you lose your mental capacity without making an LPA, your family members will need to apply to the Court for appointment of deputies, which can be tedious and costly.

You may wish to consider making an LPA if you have not done one. This is strictly optional.
